19. Waiver of Liability
    Every individual who participates in the adoption must sign a Volunteer Waiver of Liability (see attachment 1) before undertaking any actions at the adopted park/area. Any volunteer who does not sign a waiver of liability has not been granted the City of Alamogordo’s or Keep Alamogordo Beautiful’s permission to undertake any action in the adopted park/area. The Adopter Group shall submit signed waivers of liability for all approved volunteers to Keep Alamogordo Beautiful. If the Adopter Group is an organization, an officer of the organization with authority to bind the organization must sign an Adopter Group Waiver of Liability (see attachment 2).
    Recognition of Adopter Group
    The Adopter Groups will be publicly recognized on the Keep Alamogordo Beautiful webpage on the city website, recognized via social media and a letter of recognition will be presented to the Adopter Group signed by the Mayor of Alamogordo. In addition, the Adopter Group will have a sign recognizing the group at the adopted park/area if funds allow.
    Litter Kits and Reporting
    Keep Alamogordo Beautiful will supply the Adopter Group with litter cleanup kits for litter pick up. Adopter Group must notify Keep Alamogordo Beautiful 24 hours prior to the anticipated litter pick up to coordinate kit collection and return. An event report is required to be filled out for each litter pick up and returned with the litter kit.
    Term of Agreement
    The Adopter Group commits to maintaining the adopted park/area for a period of at least one year, with at least two visits per year, beginning on the date of the final signature on this agreement. This agreement will automatically renew at the end of each calendar year unless the Adopter Group or Keep Alamogordo Beautiful cancels the agreement in writing. Adopters wishing to cancel an adoption are requested to provide thirty (30) days notice in writing to Keep Alamogordo Beautiful.

    For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Organization/Group specified in this form, hereby agrees to waive, release, and discharge from any and all liability, and hold harmless Keep Alamogordo Beautiful and all of its staff, officers and directors; and the City of Alamogordo, and all of their officials, employees, volunteers, agents, and representatives, from any and all liability for negligence or any other claim, judgment, loss, liability, cost and expenses (including, without limitation, attorneys’ fees and costs) arising out of or connected with the Organization’s participation in the Adopt-A-Park/Area program.
    I warrant that I am an officer/supervisor of the Organization/Group, have the authority to execute this Waiver of Liability on behalf of the Organization/Group, and bind the Organization/Group. I have read this Waiver of Liability in its entirety and fully understand its contents. I have signed this document voluntarily and of my own free will.
